This guidance applies to travel agents operating in Canada and is an advisory regarding the Mandatory Disclosure of Non-Canadian Government Taxes (Including the Baja California Tourism Tax).
The mandatory Baja California Sur (BCS) tourism tax is not a Canadian-government-imposed tax and therefore does not fall under the Competition Act’s narrow exemption for government-imposed fees, which applies only to charges imposed by Parliament or a provincial legislature.
Travel agents must therefore clearly disclose any mandatory tourism tax that is not included in the advertised ticket or package price before purchase and must inform travelers that the tax is paid separately.
